The Missouri Prenatal Equal Protection Act (HB 1682) was filed in the Missouri House by State Representative Burt Whaley. The same bill (SB 951) was filed in the Senate Chamber by State Senator Mike Moon. This legislation aims to provide equal justice and equal protection under the law to all preborn persons. Until we provide these liberties to preborn persons, the killing of children will never end in Missouri.
Equal justice and protection are Biblical principles and Scripture commands that we provide them to all persons. By recognizing these rights of the preborn, the Act provides both the Biblical response to the murdering of children and a viable alternative to the flawed New Amendment 3 or, HJR 73, proposed by the Missouri Legislature. The New Amendment 3 (HJR 73) will be presented to Missouri voters as a constitutional amendment in 2026. This proposed constitutional amendment targets certain groups of children for death. It will specify in the state constitution the right to murder children conceived through rape and incest as well as those with fetal anomalies. It denies equal justice and protection to these groups of children, creating classes of people with lesser value. It therefore denies Biblical personhood and the sanctity of all human life. If passed, this proposed resolution will also keep the killing of all preborn children legal in Missouri. This is because it will only ban abortions performed in clinics, doing nothing to address chemical abortions performed at home. A woman can still purchase abortion pills such as Mifeprex and have them mailed to her home. She can take them and abort the baby at home. These self-managed, do-it-yourself abortions are becoming increasingly common as abortion pills become easier to purchase. Statistics show that approximately 63% of abortions are now chemical abortions. These abortions will remain legal in Missouri even if the New Amendment 3 passes.
The Missouri Prenatal Equal Protection Act, if passed, will completely abolish all legal abortions in Missouri. The legislation makes the killing of a preborn child a murder. It prohibits the murder of a preborn child by any method, just as the murder of a born person is prohibited by law by any method. The legislation recognizes God’s demand for equal justice to all people and the Constitutional requirement of equal protection under the law. It recognizes the value and sanctity of all human life and that our value is inherent in that we are all created in the image of God and not in the purpose for which we can be used.
The Missouri legislative session begins on January 7 and both bills will be introduced in their respective chambers. The leadership in each chamber needs to hear from Missouri Christians. The Church must make its voice heard and let the House and Senate leadership know that these bills must be moved forward. It is time to end the evil of child murder in Missouri. Only full equal justice and protection under the law for the preborn person can accomplish this end.

Dr. Wes Scroggins
Dr. Wesley Scroggins is a Professor of Management at Missouri State University. He teaches courses in human resource management and organizational behavior. He received his Ph.D. in management from New Mexico State University and holds an M.S. degree in industrial-organizational psychology from Missouri State University. Dr. Scroggins also holds an MDiv. degree from Midwestern Baptist Theological Seminary and is an ordained minister.
Dr. Scroggins is the Executive Director of Abolish Abortion Missouri. He is active in the fight to end abortion in Missouri and works with state legislators on abortion abolition legislation. He also works to educate the church on the issues impacting the culture.
He resides in Billings, MO where he operates a small farm.
